Privacy Policy

Just Atonement Inc.

We at Just Atonement Inc. respect your privacy. We collect certain data from you when you visit our website (www.justatonement.org) and other websites that we run and maintain such as for the #climateletter campaign (climateletter.us), so we want to tell you what data we're collecting, and what we do with it. 

Here is the data we collect from you when you visit our website:

1) Our server captures information regarding your operating system, the type of computer you are using, the type of browser you are using, your IP address, the URL link you may have come from, the search term you may have used to land on our website, the content on the website you are looking at, the time and date of your visit, and anything you might download (the "Captured Data").

Beyond that, we don't collect any other information. 

2) When you contact us through our form on the website, we may learn additional information that you provide to us. Please note that by using the form or by emailing us, there is no attorney-client privilege, and anything you provide may be deemed to be public information.

3) When you sign up to a mailing list that we may provide on the websites we run and maintain, we will learn the email you provide and the name you provide.

3) We don't learn any specific identifying information about you just by you visiting our website, other than the Captured Data. Absent further action on our part regarding the Captured Data (for example, requesting from a court a subpoena to an internet service provider regarding identifying information behind a specific IP address), we are not otherwise able to discern or uncover a person's personal identity from the Captured Data itself. Of course, if you tell us that information by disclosing it through our contact form, then we will know it at that time, and we may be able to match the information from the form with the Captured Data. As a general practice we do not do any such matching, however.

We only process your Captured Data occasionally and incidentally as part of our core non-profit practices. When we do process your data, this is what we do with it:

1) We use your data to improve and administer www.justatonement.org. For example, we might notice that people are using certain search terms that tend to point them to our website. We might use that information to create content around those areas. We might notice that a blog post we've written is generating a lot of attention. We might use that information to make more posts like that.

2) We will use your data to contact you at the email address and name you provide to us, when you contact us through our contact form, or give us permission to email you with our mailing list.

2) We use your data to protect and defend our legal rights. We might notice that data we are monitoring indicates a DDOS attack, for example. We could conceivably use the Captured Data to enact defenses and to protect the website.

Personal identifying information:

Other than the Captured Data, we don't collect any personally identifiable information, such as your name, telephone number or email address. We would only have that information if you provided it to us through our contact form, or if you email it to us. 

Links:

We might link to other websites (for example, social media platforms or other third party websites). We don't have any control over those third party websites.

How we share your information:

We don't distribute your information to any one outside of Just Atonement Inc. However, we do share information with third party software platforms or third party data hosting or analytics programs in order to run and operate the website and enhance the user experience. The Captured Data may be processed and shared with those platforms or programs as it goes through their systems. Any personally identifiable information you provide over email or through the telephone will be processed through our email system, our email host provider, our internet host provider, our website host provider and/or our phone provider system.

We do not and will never sell any information we receive from you, whether it's the Captured Data, or any personally identifiable information.

We might have to disclose and/or transfer information to our internal and external advisors and auditors, if required by law (for example, in order to comply with a judicial proceeding, a subpoena, a request from a regulator, or other legal obligation), in connection with a reorganization of our non-profit law firm, if we believe that such disclosure is necessary to otherwise protect and/or defend our rights, property, safety or that of our clients or other users of the website.

The security of your information is as follows:

We take reasonable and appropriate steps to protect your personal information, including the Captured Data, against unauthorized access or accidental loss. However, we cannot provide a guarantee that the measures we have taken are sufficient to protect any such information.

Data subject rights:

We respect your rights and control over your personal data. You may exercise any of the following rights by contacting our Global Data Privacy Officer as detailed below. Please note you may ask you to verify your identify before taking further action on your request.

a.   Right of Access - the right to be informed of and request access to the personal data we process about you;

b.   Right of Rectification - the right to request that we amend or update your personal data where it is inaccurate or incomplete;

c.   Right to Erasure - the right to request that we delete your personal data;

d.   Right to Restrict Processing - the right to request that we temporarily or permanently stop processing all or some of your personal data;

e.   Right to Object - the right, at any time, to object to us processing your personal data on grounds relating to your particular situation; the right to object to your personal data being processed for direct marketing purposes;

f.    Right to Data Portability - the right to request a copy of your personal data in electronic format and the right to transmit that personal data for use in another party’s service;

g. Right to Lodge a Complaint - You may have the right to complain to a relevant Data Protection Authority if you believe your personal information, including the Collected Data, has been collected or used in breach of privacy rules, or this Privacy Policy. If you are located in the European Union, you should contact the Data Protection Authority in the country in which you are located. If you are located in the United Kingdom, you should contact the Office of the Information Commissioner in the United Kingdom, at www.ico.org.uk.

The legal basis of processing:

It is necessary for us to use your personal information:

·       In order to perform our obligations according to any contract that we may have with you.

·       As a legitimate interest to ensure that we provide our services in the best way possible.

For California residents:

California Civil Code Section § 1798.83 permits users of our sites or services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please contact us using the information provided below.

We do not respond to “Do Not Track” (DNT) signals.

Your agreement to this Privacy Policy:

By viewing our website, you agree to this Privacy Policy. In addition, when you visit the website, we ask that you hit the "Continue" button so that the website runs properly. If you do not hit "Continue," our web platform will not run certain analytics information. However, we ask that if you don't agree to this Privacy Policy, that you simply don't visit the website. 

If we update this Privacy Policy, we'll put a banner on the front page of our website with the updates, and we will describe what we've changed in plain English. Any information you may have provided will then be subject to the new, updated Privacy Policy.

Any requests for notification of the purpose for which your data and/or personal information may be used, or how it might be deleted or erased, will be processed in accordance with our internal firm procedures and by applicable law.

If you are located in the United Kingdom, you should contact the Office of the Information Commissioner in the United Kingdom, at www.ico.org.uk. 

Rights relevant to children:

Our website is not directed to children under the age of 16, and we don't intend to, or knowingly want to, collect data, including Captured Data, from anyone under the age of 16. We do not provide services to people under the age of 16. If someone contacts us under the age of 16 and provides personal information, we will destroy that information promptly after receiving it.

December 31, 2019: Added separate Cookie Policy; added the legal basis for processing; added data subject rights; clarified that the Privacy Policy applies to the #climateletter website (climateletter.us); added a provision confirming that the processing of Captured Data is occasional and incidental to our core non-profit practices.
